These Terms of Service ("Terms") govern your access to and use of FunderIntelligence. By creating an account or using the platform, you agree to be bound by these Terms. Please read them carefully.
By accessing or using FunderIntelligence, you represent that you are at least 18 years old and have the legal authority to enter into these Terms, either on your own behalf or on behalf of the institution you represent.
If you are accessing the platform through an institutional subscription, your use is also governed by any agreement between FunderIntelligence and your institution. In the event of a conflict, the institutional agreement controls.
FunderIntelligence provides an AI-assisted platform for academic grant discovery, funder intelligence research, and proposal drafting support. The platform aggregates publicly available and licensed grant data from federal agencies, private foundations, and other funding sources, and applies AI tools to help researchers identify relevant opportunities and draft proposal materials.
The platform is intended as a research and productivity aid. It does not submit applications on your behalf and makes no guarantees about funding outcomes.
You must create an account to access most platform features. You agree to provide accurate and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.
Researchers accessing the platform under an institutional license must use their institutional email address for registration. Institutional administrators may provision, suspend, or terminate user accounts within their organization.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or remain inactive for an extended period, with notice where practicable.
You agree to use FunderIntelligence only for lawful purposes consistent with academic research activities. You must not:
FunderIntelligence does not warrant the accuracy, completeness, or fitness for purpose of any AI-generated content. The use of AI in proposal preparation may be subject to restrictions imposed by your institution or funding agency — you are responsible for ensuring compliance with all such policies.
Grant opportunity data displayed on the platform is sourced from third-party databases and may not reflect real-time availability, deadlines, or funding levels. Always verify opportunity details directly with the funding agency before preparing a submission.
FunderIntelligence and its licensors own all intellectual property rights in the platform, including software, design, AI models, aggregated data compilations, and documentation. These Terms do not grant you any ownership interest in the platform.
You retain ownership of all research materials, documents, and original content you upload to the platform ("User Content"). By uploading User Content, you grant FunderIntelligence a limited, non-exclusive license to process and store that content solely to provide the service to you.
We do not claim ownership of your research ideas, grant narratives, or outputs you generate using the platform. However, because AI systems are involved in generation, we cannot guarantee that outputs are entirely novel or free from third-party claims.
If you provide feedback, suggestions, or feature requests, you grant us a perpetual, royalty-free right to incorporate them into the platform without obligation to you.
Access to certain features requires a paid subscription. Current pricing is available on our pricing page. We reserve the right to modify pricing with 30 days' notice to active subscribers.
Subscriptions are billed in advance on a monthly or annual basis. By providing payment information, you authorize us to charge your payment method for all applicable fees.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access through that date. We do not provide prorated refunds for partial billing periods except where required by law or where a material service failure is attributable to us.
Institutional subscriptions are governed by the terms of the applicable institutional agreement. Contact institutions@funderintelligence.com for institutional pricing and invoicing.
Your use of the platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using FunderIntelligence, you consent to the data practices described in the Privacy Policy.
The platform may display links to third-party grant databases, agency websites, and external resources. These links are provided for convenience only. FunderIntelligence is not responsible for the content, availability, or practices of third-party sites, and such links do not constitute an endorsement.
Our platform relies on third-party infrastructure and AI providers (see our Privacy Policy). We are not liable for service interruptions or data incidents attributable to those third parties beyond our reasonable control.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE; (B) GRANT DATA WILL BE ACCURATE, CURRENT, OR COMPLETE; (C) AI-GENERATED CONTENT WILL BE SUITABLE FOR SUBMISSION TO ANY PARTICULAR FUNDER; OR (D) USE OF THE PLATFORM WILL RESULT IN SUCCESSFUL GRANT FUNDING.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNDERINTELLIGENCE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO FUNDERINTELLIGENCE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless FunderIntelligence and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the platform in violation of these Terms; (b) your User Content; or (c) your violation of any third-party rights or applicable law.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law provisions.
Any dispute arising from or relating to these Terms or the platform that cannot be resolved informally shall be submitted to binding arbitration administered under the rules of the American Arbitration Association, with proceedings conducted in English. The arbitration shall take place in Williamsburg, Virginia. This arbitration agreement does not apply to claims for injunctive relief or enforcement of intellectual property rights, which may be brought in any court of competent jurisdiction.
CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
We reserve the right to modify or discontinue any feature of the platform at any time, with or without notice. We will provide reasonable notice of changes that materially reduce core functionality available under a paid subscription.
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before the update takes effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
Entire Agreement: These Terms (together with the Privacy Policy and any applicable institutional agreement) constitute the entire agreement between you and FunderIntelligence regarding the platform and supersede all prior understandings.
Severability: If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
No Waiver: Failure to enforce any right under these Terms does not constitute a waiver of that right.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of all or substantially all of our assets.
